TERMS AND CONDITIONS
These terms and conditions apply to orders placed with The Mazawattee Tea Company Limited (‘Mazawattee Tea’, ‘Mazawattee’, ‘we’, ‘us’ and ‘our’) through mazawattee-tea.com, mazawattee-tea.co.uk, by email, by telephone or by any other method, unless we have agreed different terms with you in writing.
Please read these terms before placing an order. You must be 18 or over to place an order with us.
If you are an individual buying wholly or mainly for purposes outside your trade, business, craft or profession, you are purchasing as a consumer (‘Consumer’). If you are purchasing wholly or mainly for purposes of a trade, business, craft or profession, you are purchasing as a business customer (‘Business Customer’).
If we have separately agreed trade or other terms with you, those terms will take precedence to the extent that they differ from these terms.
Your Purchase Order
An order you place with us is an offer to buy the goods specified in your order. A contract between you and Mazawattee is formed when we expressly accept your order. An acknowledgement that we have received your order does not itself constitute acceptance.
All orders are subject to availability. If we are unable to accept your order, for example because an item is unavailable, payment cannot be authorised, there is an error in the price or description or we cannot deliver to your address, we will let you know and refund any payment already taken.
For orders placed by email, telephone or another method outside our website, we will make these terms available to you before accepting your order. Where required by law, we will also provide a Consumer with confirmation of the contract and the required information by email or another durable medium.
We take reasonable care to ensure that product descriptions, details and prices are accurate. If, after you place an order but before we accept it, we discover an error in the price, description or other material information, we will contact you and give you the opportunity to proceed on the corrected basis or cancel your order. If we discover an error after accepting your order, we will contact you as soon as reasonably possible to explain the position.
We may update products, prices and website content from time to time. Any change will not affect an order that we have already accepted.
Payment
Prices displayed on our website are shown in pounds sterling and include VAT where applicable. Prices quoted separately to a Business Customer may be stated either inclusive or exclusive of VAT. Where a quoted price is exclusive of VAT, VAT will be added at the applicable rate. Delivery charges are shown or quoted separately where applicable.
Payment may be made using the payment methods available at checkout or any other payment method that we agree with you. Unless we have agreed credit or other payment terms in writing, payment must be made in full before dispatch.
Where we have agreed credit terms with a Business Customer, payment must be made by the due date stated on the invoice. Where applicable, we reserve the right to claim statutory interest and recovery costs on late commercial payments.
Where a payment is processed by a payment provider, including Stripe for card payments, the provider may carry out security and fraud-prevention checks in accordance with its own terms and privacy information. We may decline an order if payment is not authorised.
If you are a Consumer, risk in the goods remains with us until they come into the physical possession of you or a person identified by you to receive them. If you arrange delivery using a carrier of your own choosing that we did not offer, risk passes to you when we deliver the goods to that carrier.
If you are a Business Customer, risk in the goods passes to you when the goods are delivered to the delivery address or to a person identified by you to receive them. If you arrange delivery using a carrier of your own choosing, risk passes to you when we deliver the goods to that carrier.
The delivery charges and estimated delivery times on our Delivery page apply unless we have agreed otherwise with you. The consumer cancellation and return rights described on that page apply to Consumers. A Business Customer may cancel an accepted order or return non-faulty goods only with our prior written agreement, unless we have separately agreed different trade terms.
Nothing in these terms affects any rights you may have in relation to faulty, damaged or incorrectly supplied goods.
Complaints
We would like to hear from you if you have any complaints or feedback about our products or services.
Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing in these terms affects a Consumer’s statutory rights.
If you are a Consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable. We are not responsible for business losses, including loss of profit, revenue, business or business opportunity, arising from a purchase made as a Consumer.
If you are a Business Customer, subject to the first paragraph of this section and to the extent permitted by law, we will not be liable for any indirect or consequential loss, or for loss of profit, revenue, business, business opportunity, anticipated savings or goodwill. Our total liability arising out of or in connection with an order placed by a Business Customer will not exceed the total price paid or payable for that order.
Our website may contain links to third-party websites. These are provided for convenience and information only. We do not control third-party websites and are not responsible for their content, availability or privacy practices.
We take reasonable care to keep our website available and secure, but we cannot guarantee that it will always be available without interruption.
Indemnity
This section applies only if you are a Business Customer.
You will indemnify Mazawattee against reasonable losses, liabilities, damages, costs and expenses, including reasonable legal costs, that we incur as a direct result of your material breach of these terms, your negligence or unlawful conduct or your unauthorised modification, relabelling or misleading marketing of our products, except to the extent that the relevant loss, liability, damage, cost or expense was caused by our own breach, negligence or unlawful conduct.
Promotions and Competitions
PROMOTIONS AND DISCOUNT CODES
From time to time we may offer promotional, discount or trade codes. Unless the specific promotion, code or separately agreed trade terms state otherwise:
a code must be used before its stated expiry date
only one promotional or discount code may be used per order
the code applies only to qualifying products
the code does not apply to delivery charges
the code cannot be combined with other promotions or discounts
codes have no cash value and cannot be exchanged for cash
promotions are subject to availability
codes cannot be applied retrospectively to previous purchases.
If an item purchased using a promotional, discount or trade code is returned and a refund is due, the refund will be based on the amount actually paid for that item after the relevant discount.
We may withdraw or amend a promotion or code where reasonably necessary. This will not affect an order that we have already accepted.
COMPETITIONS
Any competition or prize draw run by Mazawattee will be subject to the specific terms and conditions published with that competition. Those terms will set out who may enter, how to enter, the opening and closing dates, the prize, how winners will be selected and any other conditions that apply.
General
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce any provision of these terms, that does not mean that we have waived our right to enforce it later.
If you are a Business Customer, these terms, together with any quotation, order confirmation and any other terms expressly agreed between us in writing, constitute the agreement between us in relation to the relevant order. Nothing in this paragraph limits or excludes liability for fraud or fraudulent misrepresentation.
These terms are governed by the laws of England and Wales.
If you are a Consumer, you may bring legal proceedings in the courts of the part of the United Kingdom in which you live. If you live outside the United Kingdom, you may also have mandatory rights under the law of the country in which you live.
If you are a Business Customer and we have not separately agreed otherwise in writing, the courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these terms or an order.
The content of this website and content identifying Mazawattee are protected by copyright, trade marks and other intellectual property rights. You may use the content for your personal and non-commercial use. You must not reproduce, modify, distribute or use protected content for commercial purposes without our permission, except where permitted by law.
